MotoKin Terms of Use
Effective November 7, 2026
These terms are an agreement between you and Timothy Oulette, an individual based in Alberta, Canada ("we"), who runs MotoKin. By creating an account or using MotoKin, you agree to them. Our Privacy Policy explains how we handle your information.
MotoKin is not an emergency service
In an emergency, call 911 or your local emergency number first. MotoKin does not contact emergency services. Rider in Need and crash detection are extra ways to reach nearby riders, and they may fail.
- An alert needs a phone signal, and many roads have none. An alert may not be sent or delivered, and nobody may see it or respond.
- Crash detection can miss a crash, and it can mistake something else for one.
- Riders who respond are other members of the public. We don't check, train or supervise them. Meeting them is your choice.
Who can use MotoKin
You must be at least 17 years old. You're responsible for what happens on your account, so keep your password private and give true information.
Riding safely
You are always responsible for how you ride. Don't handle your phone while riding. Follow the law and road signs, and use your own judgment.
Maps, routes, speed limits, traffic, weather, trail access, logging roads, speed trap marks and camera locations come from other people and services. They may be wrong, missing or out of date. A road or trail on the map may be closed, private, dangerous or illegal to ride. Speed trap marks are not a way to avoid the law, and it's your job to know what's allowed where you ride.
Community rules
We have no tolerance for objectionable content or abusive riders. You must not:
- harass, threaten, stalk or hate on anyone, or share someone's private information or location;
- post anything sexual involving a minor, sexually explicit, violent, hateful or illegal;
- promote dangerous or illegal riding, such as street racing;
- send false alerts or false reports, or impersonate anyone;
- spam, sell to riders without permission, or scrape or attack the service.
You can block riders and report content in the app. We review reports within 24 hours. We may remove content and suspend or close accounts that break these rules, with or without notice.
Rides, events and meeting people
Rides, events and groups are organized by riders, not by us. We don't check them. You join at your own risk and are responsible for your own bike, licence and insurance.
Your content
You own what you post. You give us a worldwide, non-exclusive, royalty-free licence to store, show and share it in MotoKin, according to your settings, so the app can work. This ends when you delete the content or your account, except for copies kept as our Privacy Policy describes. Only post what you have the right to post.
Changes and ending your account
MotoKin is free right now, and it may change, or features may stop, at any time. MotoKin is in development and may have errors. You can delete your account at any time in the app.
If we change these terms in a significant way, we'll tell you in the app before the change takes effect. If you don't agree, you can stop using MotoKin and delete your account.
MotoKin may be transferred to a company that the current operator controls, or sold or merged. These terms then continue between you and the new operator, and we'll tell you in the app.
Our responsibility
We provide MotoKin as it is, without promises that it will always work, be accurate or be safe to rely on. To the extent the law allows, we aren't responsible for injury, damage or loss from using MotoKin, from riding, or from what other riders do.
Nothing here removes rights you have under consumer protection laws that can't be waived, including the laws of your province. In particular, nothing limits our responsibility where the law doesn't allow it, such as for bodily injury in Quebec.
Law that applies
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. If you live in another province, you keep the protection of your own province's consumer laws and may be able to bring a claim there.
Apple
If you got MotoKin from the App Store, these terms are between you and us, not Apple. We alone are responsible for MotoKin and its content, for support, for any legal or product claims about it, and for any claim that it infringes someone's rights. Apple has no duty to provide support. If MotoKin fails to meet a warranty that applies, you may tell Apple, who will refund any price you paid; Apple has no other warranty duty. Your licence is to use MotoKin on Apple devices you own or control, as the App Store terms allow. You confirm you aren't in a country under a US government embargo or on a US prohibited parties list. You must also follow any third-party terms that apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
